Shopping terms

1. INTRODUCTION

1.1 These shopping terms states purchase rules between the owner of the electronics shop www.empei.cz (seller) and customer (buyer). The seller is EMPEI, s.r.o. company - quarters in Brno, Slevacska 44, 615 00, ID 26894602, registered in a trade register by a Regional court in Brno, part C, enclosure 43827. All contracts are enclosed under legal order of the Czech Republic. If the contracting party is a consumer, all relations non-regulated by these Shopping terms are regulated by Civil Code (number 40/1964 Sb.) and by a consumer protection law (number 643/1992 Sb.). If the contracting party is not a customer, all relations non-regulated by these Shopping terms are regulated by Commercial Code (number 513/1991 Sb. and its novels).

2. ORDER

2.1 Order can be made using on-line shopping cart, emailem, ICQ, MSN or via classic e-mail.

2.2 All forms of order mentioned in 2.1 are obligatory.

3. CLAIM

3.1 Sales returns are regulated by a Claim order of EMPEI, s.r.o. and by relevant laws of the Czech Republic.

3.2 Claims can be lodged in chartered services. This solution is a faster way of appropriate claim.

3.3 Claims can be lodged by a seller.

4. CANCEL OF PURCHASE AGREEMENT CONCLUDED USING DISTANT COMMUNICATION

4.1 According to §53, article 7 and §54 of the Civil Code, the consumer has a right to cancel the purchase agreement till 14 days after agreement conclusion. Information about this decision has to be delivered to the seller at latest in the 14th day after takeover of the goods. This right is not a way of claim solution. This right can be applied only with goods in original condition and has to be in undamaged package, must not be damaged and has to be complete (that means including accessories, warranty list, manual etc.). This regulation does not refer to a customer that is not a consumer. Never use a cash on delivery method for consignation the goods back to us. Appropriate financial transactions method will be made after according to agreement. In case of nonfulfilment of the above mentioned terms the cancel of the agreement can be accepted only if the consumer is willing to make restitution of the decrease in value of the goods. This refers to a agreement concluded at a distance.

5. RIGHTS AND DUTIES OF THE SELLER

5.1 The seller must realize the obligatory order of the buyer and post the goods till agreed deadline.

5.2 The seller will emit the tax document. If the buyer is a VAT payer, the tax document has to include VAT specifications.

6. RIGHTS AND DUTIES OF THE CUSTOMER (BUYER)

6.1 The buyer must provide his name and description needed for successful order fulfilment.

6.2 The buyer has to pay the agreed amount in specified time and date.

6.3 The buyer has to take over the goods in specified time and date.

7. CONCLUSION

7.1 These shopping terms are obligatory to the buyer beginning with the date of order submission.
